Terms of Use

1. Who we are
These Terms govern access to and use of the Lipé app (the "Service"), offered by Tipo Horta ("we", "us"). By using the Service, you contract directly with Tipo Horta.
2. Acceptance
By creating an account, subscribing to a plan, or continuing to use the Service, you declare that you have read, understood and agreed to these Terms and our Privacy Policy. If you disagree, do not use the Service.
3. Who can use
You must be at least 18 (or the legal age in your jurisdiction) and provide accurate, complete and up-to-date information. You are responsible for keeping your credentials confidential and for all activity on your account.
4. Service description
Lipé offers a 21-day protocol, personalized meal plans, functional tea recipes, self-massage techniques, a progress journal and a community — as wellness tools for women with lipedema.
Medical disclaimer: the Service is not a substitute for professional medical diagnosis, treatment or advice. Always consult your doctor before changing your diet, routine or treatment.
5. Acceptable use
You agree NOT to:
- Use the Service for illegal, fraudulent or deceptive purposes;
- Send spam, malware or abusive, defamatory content or content infringing third-party rights;
- Violate intellectual-property rights of third parties;
- Try to bypass technical limits, reverse-engineer, probe vulnerabilities, or perform unauthorized scraping;
- Share your account or resell access to the Service.
6. Intellectual property
The Service, its software, design, brand, editorial content and materials (meal plans, recipes, videos, texts) are owned by or licensed to Tipo Horta. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service within your plan.
7. User content
You retain ownership of the photos, notes and content you submit. By submitting them, you grant Tipo Horta a limited license to host and process that content solely to provide the Service.
8. Payments, subscriptions and refunds
Payment processing, recurring billing, invoicing, taxes, cancellations and refunds are governed by Paddle's Buyer Terms. For our refund policy, see the Refund Policy.
Our order process is conducted by the online reseller Paddle.com. Paddle.com is the Merchant of Record for all our sales. Paddle provides all customer service for orders and handles returns.
9. Service level
We strive to keep the Service available but do not guarantee uninterrupted, error-free or absolute availability. Maintenance, third-party failures and events outside our control may cause downtime.
10. Warranties and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and we disclaim implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability for any claim related to the Service is limited to the amounts you actually paid in the 12 months prior to the event. We are not liable for indirect damages, lost profits or data loss. We do not exclude liability for willful misconduct, fraud or other matters that cannot be excluded by law.
11. Suspension and termination
We may suspend or terminate your access, with or without notice, in case of: breach of these Terms, default, fraud or security risk, or repeated/serious policy violations. You may close your account at any time via the subscription portal. Clauses that by their nature should survive termination (intellectual property, limitations of liability, jurisdiction) remain in force.
12. Indemnification
You agree to indemnify Tipo Horta for third-party claims arising from your content, misuse of the Service or breach of these Terms.
13. Changes
We may update these Terms. Material changes will be notified with reasonable advance by email or in the Service. Continued use after the effective date implies acceptance.
14. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the city where Tipo Horta is headquartered are the elected venue, waiving any other, however privileged.
